Referral C-51/26 (Netflix International and Netflix Services Italy, 3 Feb 2026)



Must EU legislation, in particular Directive (EU) 2019/790 of the European Parliament and of the Council of 17 April 2019 on copyright and related rights in the Digital Single Market and amending Directives 96/9/EC and 2001/29/EC, be interpreted as precluding national legislation which also confers the power to impose a contribution towards the financing of the activities of the regulatory authorities in the sector on undertakings active in the video-on-demand sector – to be understood as persons providing an online service for viewing audiovisual products at the user’s request – even without taking into account the intensity of the regulatory and monitoring activities carried out in relation to the various types of services?
